According to the Nov. 9 opinion, authored by Sixth Circuit Judge John K. Bush, the case concerned an alleged breach of fiduciary duty based on a claimed de facto fiduciary relationship under Ohio law, leaving the court to determine whether a fiduciary relationship existed between Vesi and Vera Bradley.
