Two companies have appealed a judge’s order refusing to disqualify the special master in the opioid multidistrict litigation after he inadvertently hit “reply all” on an email meant for himself.

Pharmacy benefit managers OptumRx Inc. and Express Scripts Inc. petitioned the U.S. Court of Appeals for the Sixth Circuit this week to overturn U.S. District Judge Dan Polster’s Oct. 10 order denying their request to disqualify David Cohen, who was appointed special master in 2018.
