The U.K.’s Competition Appeal Tribunal has provisionally given the go ahead to a £853 million opt-out class action being brought against Apple on behalf of U.K. iPhone users.

Lead claimant Justin Gutman had applied to the court for a collective proceedings order, arguing that Apple deceived 23.8 million iPhone users by not informing users that software updates would significantly diminish the performance of their phone.
