In a matter of first impression, the Oklahoma Supreme Court addressed whether proceeds from a wrongful death case could be transferred into a trust before they’re obtained by the trust settlor.

After a couple died before they received the damages from their son’s wrongful death lawsuit, the court was faced with the question of whether the proceeds could be transferred to a trust prior to being obtained. The court determined that yes, the proceeds could be transferred before they were obtained, and if they were obtained, they belonged in a trust.
