A split Arizona Supreme Court overturned an $800,000 jury verdict to the families of two people killed by a drunken driver last week after it upheld a state law restricting liability to establishments for damages caused by intoxicated customers.
The high court’s decision denied the plaintiffs’ contention that state’s dram-shop liability statute violated a provision of its constitution that limits legislators from passing laws that could abrogate any right to bring a legal action before Arizona’s statehood in 1912.
