A split West Virginia Supreme Court has affirmed a circuit court’s order dismissing a legal malpractice complaint in which a client alleged his lawyer failed to get the blood test results of a DUI stop admitted into evidence.

In a Sept. 15 opinion, the majority affirmed a circuit court’s order granting Ryan J. Flanigan and Flanigan Law Office’s motion to dismiss former client Jeremy B. Vaughn’s legal-malpractice claim against them.
