A split U.S. Court of Appeals for the Ninth Circuit, sitting en banc, held Monday that universities and colleges may be held liable for harassment that occurred in off-campus student housing.
The 8-3 majority opinion from the appellate court reversed a February 2022 decision from a three-judge panel from the same court.
