A federal judge in Massachusetts sided with an employer when a former employee brought a lawsuit alleging that the company violated her employment contract and the Massachusetts Wage Act by invoking its “windfall provision” to reduce her earned commission on a $2 million sale.

U.S. District Judge Indira Talwani of the District of Massachusetts sided with D2L Ltd. and its Chief Executive Officer John Baker, after former employee Susan Green claimed her bonus was wrongly capped. According to the Sept. 15 opinion, Talwani granted the defendants’ motion for summary judgment regarding Green’s claims, finding that she was properly paid the commission owed to her.
