Attorneys representing a Boston staffing agency that was ordered to pay a competitor firm more than $5 million for allegedly misappropriating trade secrets said they intend to file a motion for judgment as a matter of law within the next few weeks, arguing that a jury never identified what information was stolen in the first place.

During a June trial in U.S. District Court for the District of Massachusetts, a jury found the defendants, Catapult Staffing, and the managing director of its Boston office, Andrew Dickhaut, liable for $312,000 for misappropriating trade secrets from BioPoint. Both companies identify, recruit and place qualified candidates with employer clients looking to fill vacancies and the firms receive a “bill rate” for the consultant’s work, according to the district court’s order filed April 25.
