A 3M subsidiary asked a federal appeals court on Monday to reverse a bankruptcy ruling that has allowed lawsuits over its dual-ended combat earplugs to move forward toward trials.

U.S. Bankruptcy Chief Judge Jeffrey Graham’s Aug. 26 decision conflicts with case law and bankruptcy code allowing jurists to extend the automatic stay to parties other than the debtor, according to subsidiary Aearo Technologies’ brief before the U.S. Court of Appeals for the Seventh Circuit.
