Finding an inspection company satisfied the three prongs of the so-called ABC test, the Massachusetts Court of Appeals overturned a lower court’s decision that independent home inspectors performing work on behalf of the company were eligible for unemployment benefits.

On Wednesday, the appellate court held that the employer, Tiger Home Inspection, met its burden to show that the inspectors are not employees under the meaning of the unemployment statute, G. L. c. 151A, according to a unanimous three-judge panel’s opinion.
