Big data has become a big nightmare for lawyers and IT professionals alike. But Amy Malone in a post on Mintz Levin’s Privacy & Security Matters blog has some helpful tips for companies to protect their data and security interests.

  • It’s not all up to IT: “To effectively arm your organization against data security threats you need to realize that IT is only one piece in an effective information risk management,” says Malone. Instead, education and training for all employees around privacy and information security is paramount.
  • Delete, delete, delete: Malone explains that policies should be implemented surrounding data retention and deletion, with emphasis on the deletion wherever possible, since the less information you have, the less that can be lost or stolen.
  • Profit from others’ losses: It doesn’t sound nice, but use the high-profile data attacks to raise the issues with board members and employees, which will help “hammer home why data security is such an important topic,” says Malone.
  • Know thy business: Malone explains that it’s imperative to understand how the business operates, and how information is collected, used and shared. This must be done every time a new product is developed or changed.
  • Don’t forget about vendors: Conduct vendor reviews and assess risk there. And don’t forget those privacy and data security clauses in your contracts with them, warns Malone.
