It what sounds like a plot from legal television drama “Better Call Saul,” prosecutors filed a motion Tuesday in a federal court in Tacoma, Washington, requesting an inquiry into whether $908,397 paid into a trust account of Davis Wright Tremaine represents a potential conflict of interest in the firm’s representation of embattled Washington State Auditor Troy Kelley, indicted in April on charges related to stolen fees from former business clients and tax evasion.
Mark Bartlett, a litigation partner in Davis Wright’s Seattle office after joining the firm in 2010 following a 25-year career as a state and federal prosecutor, is representing Kelley in the case. He told The Am Law Daily he had no comment regarding the government’s motion filed Tuesday.
