Ex-Duane Reade CEO Anthony Cuti must reimburse his former company for employees’ legal fees incurred during a fraud investigation that landed the executive in prison, a federal appeals court said Thursday.

Clarifying the law on restitution, the U.S. Court of Appeals for the Second Circuit also said Cuti must pay restitution to Oak Hill, the hedge fund that bought Duane Reade, as a “non-victim” under the Victims and Witnesses Protection Act, 18 U.S.C. §3663.
