The Philadelphia Inquirer and Daily News are asking the Supreme Court to decide the state of the law on false-light invasion of privacy in Pennsylvania before discovery or a trial begins in a defamation suit brought against the papers by one of the court’s own justices.

In a July 17 filing with the state Supreme Court in Rapaport v. Interstate General Media, the parent company of Philadelphia’s two major daily newspapers is asking the court to rule on the constitutionality of the tort of false-light invasion of privacy when it comes to a public official.
