For the second time this year, a Nebraska federal judge has rejected a class-action settlement in an alleged text-message “cramming” case, ruling that, among other things, the $3 million it offers is way too little for the estimated 31 million victims who may make up the class.
U.S. District Judge Joseph Bataillon on July 31 again rebuffed the parties in Cullan & Cullan v. M-Cube for agreeing to a flawed deal. On Jan. 30, he’d denied an agreement containing many of the same components and alleged insufficiencies.
