The Delaware Court of Chancery interpreted for the first time how attorney fees should be calculated in a civil case alleging violations of Delaware’s Misuse of Computer System Information Act. In the opinion, the court nearly halved the attorney fees requested for litigating unjust enrichment claims, ruling it was unlikely the plaintiff’s attorneys spent that much time on the computer misuse claim compared to the claims raised in the case.

Wayman Fire Protection Inc., a Delaware corporation that sells, designs, installs and maintains fire protection systems, filed a lawsuit against Premium Fire & Security LLC, a rival company located in Kennett Square, Pa., and several of its former employees. The lawsuit, Wayman Fire Protection v. Premium Fire & Security, alleged several former Wayman employees misappropriated trade secrets when they joined Premium Fire & Security.
