Hooters’ employee handbook has unlawful sections, according to the National Labor Relations Board. Associate Ashley Laken of Seyfarth Shaw reports that an administrative law judge found both the handbook and a recent firing of a waitress contravened the National Labor Relations Act.

The waitress was complaining to a regional manager a few days before the restaurant’s bikini contest and alleged that other managers were making unprofessional remarks about some of her coworkers’ appearances. “She also expressed that she was not looking forward to the bikini contest because it was ‘rigged’ and the girls were forced to participate without being paid,” explains Laken. At the contest, Laken says two coworkers got into an argument and the waitress played a minor role in it, and she was fired.
