Spring is a good time to get into shape for summer. But as Quarles & Brady partner Amy Ciepluch and associate Sarah Fowles explain in an employee benefits law alert, it’s also an opportunity for companies to ensure their wellness programs are in compliance.

They say following the rules can be trickier for “outcome-based wellness programs” that offer incentives for healthy behavior. These programs require an individual to attain or maintain a specific health outcome to get a reward under a group plan. They might also impose a “surcharge” on an employee who uses tobacco, causing that person to pay more for coverage.
