A hedge fund suing its accountants for malpractice is trying to kick McCarter & English out as defense counsel, saying the law firm has an irreconcilable conflict of interest.
The alleged conflict is that McCarter’s representation of Wiss & Co., whose professional liability carrier Liberty Insurance Underwriters is paying for the defense, means that McCarter in fact represents both companies.
