The Delaware Superior Court has dismissed a toxic-exposure lawsuit filed by a group of Central American banana plantation workers against Dole Food Co., Shell Oil Co. and Dow Chemical Co. that included claims that had been rejected last year by a Louisiana federal court.

Writing in Chaverri v. Dole Food, Judge Andrea L. Rocanelli dismissed the plaintiffs’ claims under the first-filed” doctrine stated in a 1970 decision of the state Supreme Court, McWane Cast Iron Pipe v. McDowell-Wellman Engineering.
