The U.S. Court of Appeals for the Third Circuit has ruled that the Delaware Court of Chancery’s confidential arbitration program is unconstitutional because it violates the public’s right to access civil trials under the First Amendment.
The appellate court’s decision, affirming a U.S. District Court for the Eastern District of Pennsylvania ruling, reduces the Chancery Court’s chances of resuscitating the program.
