When it comes to Christian Louboutin’s trademarked red-soled heels, litigation is so last season. Yves Saint Laurent, represented by David Bernstein at Debevoise & Plimpton, is walking away from its remaining claims in the closely watched suit over Louboutin’s attempt to enforce its trademark for red lacquered soles by keeping YSL from selling all-red high heels.

In a motion filed yesterday, YSL asked Southern District Judge Victor Marrero (See Profile) to voluntarily dismiss its six pending counterclaims against Louboutin. After Louboutin targeted YSL’s line of monochrome red shoes last April, YSL fired back with claims seeking to cancel Louboutin’s trademark registration. YSL also alleged tortious interference and unfair competition based on Louboutin’s efforts to warn retailers against selling the all-red YSL pumps.
