Lawyers told a federal appeals court on Monday that a judge’s pretrial rulings prevented 3M from presenting a pivotal defense to jurors in two trials involving its combat earplugs that ended in verdicts totaling more than $8 million.
The U.S. Court of Appeals for the Eleventh Circuit heard the appeals of two of the 16 earplug trials in Florida: one ended in a $7.1 million verdict to three plaintiffs, and another, to one plaintiff, an award of $1.7 million, for which 3M was found 62% responsible.
