A suit against low-carb diet promoter Dr. Robert Atkins over his cancer treatment recommendations will go forward now that a Manhattan judge has dismissed the Atkins estate's motion for summary judgment. The judge ruled that public policy forbade the court from enforcing a legal-release provision in the Atkins Center for Complementary Medicine's consent form signed by the since-deceased plaintiff. The suit marks at least the second time that Atkins' breast cancer treatments have resulted in litigation.
