Philip Morris and Winston & Strawn have defeated a whistleblower lawsuit alleging that the company overcharged the military for cigarettes. A judge ruled on Thursday that the whistleblower wasn't the first person to point out the pricing discrepancy, which had already been publicly disclosed in a 1998 tobacco industry settlement.
