Distinction Between General and Consequential Damages

In his Contract Law column for The New York Law Journal, Glen Banks reviews a recent Court of Appeals in which the majority said that lost profits could be either general or consequential damages dependent upon whether the non-breaching party bargained for the right to receive the profits and the profits were the direct and immediate fruits of the contract.
