SAN FRANCISCO — A state court of appeal has resurrected allegations that Apple Inc. falsely claimed its iPhone 3G was “twice as fast” as the earlier model.
The lower court erred when it dismissed the false advertising class action because the complaint did not also target AT&T Mobility, the network carrier for the iPhone 3G, a Sixth District Court of Appeal panel unanimously ruled Friday.
