Fox News Network and its lawyers at Kirkland & Ellis suffered a big blow on Tuesday in their copyright case against TVEyes Inc., a service that allows corporations, media watchdogs and political campaigns to track what cable news pundits are saying.
U.S. District Judge Alvin Hellerstein in Manhattan dismissed claims that TVEyes infringes Fox’s copyrights, writing in a lengthy ruling that its core business model is protected by the doctrine of fair use. Part of the case still remains, however, because Hellerstein wrote that he needs further briefing on whether TVEyes infringes through certain features, like the ability to share clips through social media.
