After winning two bellwether suits over femur fractures suffered by users of the osteoporosis drug Fosamax, Merck & Co. is seeking dismissal of the roughly 500 remaining cases in the mass tort litigation in federal court in Trenton, N.J.
On Aug. 15, Merck filed an application for entry of an order to show cause why all pending claims in In Re: Fosamax Products Liability Litigation should not be dismissed.
