Louis J. Freeh has filed an action for declaratory judgment in federal court, seeking an interpretation of the federal removal statute after a state court’s ruling that it wouldn’t force former Penn State President Graham B. Spanier to outline his claims against Freeh in a possible defamation lawsuit.

Spanier has successfully argued for a stay of his defamation action against Freeh, begun with a writ of summons in state court, until the criminal trial against Spanier over his response to reports of sex abuse by Jerry Sandusky is completed. Freeh argued Spanier should be forced to file a complaint in the action so that Freeh can confidently remove the case to federal court within that court’s one-year statute of limitations for removal.
