In a case in which the Pennsylvania Supreme Court had harsh criticisms for the Commonwealth Court and suggested the state's hiring of outside counsel on a contingency fee basis lengthened the 10-year litigation, the high court remanded for reconsideration $80 million in damages assessed against two pharmaceutical companies.

    Some of this opinion is nonsensical. The Judge suggesting its better for the process and the taxpayer for counsel to not be incentivized means his personal opinion is the taxpayer should have to pay hourly fees to counsel for litigation which may not have any prospect of success. Logic Fail
