Lowe’s prevails over former employees’ claims

On March 14, a judge sided with Lowe’s in a lawsuit brought by four former employees who claimed that they were fired for seeking workers’ compensation due to on-the-job injuries. The customer service associates claimed back injuries, but no injury claim was part of this suit. Lowe’s argued it terminated the plaintiffs under a neutral absence-control policy, after the plaintiffs remained out on personal leave beyond the time allowed by the policy. Lowe’s moved for a directed verdict, maintaining that substantive law did not permit the plaintiffs to recover on their causes of action. The court ruled there was no causal connection between the termination of their employment and the filing of their workers’ compensation claims.
