The plaintiffs in the Risperdal mass tort litigation have asked a Philadelphia judge to reconsider his decision last month barring them from seeking punitive damages in any of their cases.

In a May 2 order in In re Risperdal Litigation, Philadelphia Court of Common Pleas Judge Arnold New said in a footnote that New Jersey law applies to the plaintiffs’ claims alleging Janssen Pharmaceuticals engaged in off-label marketing of Risperdal to children that resulted in alleged damages that included boys developing breasts as a result of taking the drug.
