A federal judge in Pennsylvania has refused Walgreen Co.’s motion to boot a proposed class action that alleges the company falsely claims some of its nutritional supplements can rebuild cartilage.

Walgreen had asked U.S. District Judge Arthur Schwab do dismiss the complaint because plaintiff Brian Calvert presented only “irrelevant clinical studies” to back up his claim that supplements glucosamine and chondroitin do not regenerate cartilage, as Walgreen’s labeling and marketing imply.
