Thanks to a quick jury verdict that could be worth tens of millions of dollars for their client, lawyers at Kaye Scholer are claiming a major victory in a Delaware patent case that nearly fizzled out three years ago.

A federal jury in Wilmington returned a verdict on April 11 that Germany’s Broetje Automation GmbH (BA Group) infringed patents and trade dress belonging to France’s Ateliers de la Haute-Garonne (AHG). The jurors also sided with AHG on its claims of unfair competition and intentional interference with prospective economic advantage. According to Kaye Scholer, jurors awarded about $14 million in damages— close to $2 million for patent infringement, $6 million for trade dress infringement, and $6 million in punitive damages on the tort claims. AHG now plans to seek treble damages and attorneys fees based on the jury’s willfulness finding.
