The Delaware Court of Chancery last week continued its fight to revive its confidential arbitration program through legal briefs with the U.S. Supreme Court, submitting a reply brief to the Delaware Coalition for Open Government’s opposition to the Chancery Court’s petition for certiorari.

In the brief, the Chancery Court asserted that the Supreme Court needs to review the program because it is not similar to a civil trial and, therefore, does not violate the public’s right to access court proceedings under the First Amendment.
