Face the Fax—A group bringing a class-action suit over receiving unsolicited faxes can be contacted by its legal representation by—what else?—fax, Judge Jerome Simandle ruled Monday in District Court in Camden.
The suit, City Select Auto Sales Inc. v. David Randall Associates, is one of many filed nationwide under the Telephone Consumer Protection Act (TCPA) against companies that sent unsolicited faxes through Business to Business Solutions. More than 40,000 faxes were sent to 29,113 fax numbers in spring 2006, promoting David Randall Associates’ roofing services.
