SAN JOSE — A name plaintiff in the no-poach litigation against some of Silicon Valley’s largest companies was killed last week by a Santa Clara County sheriff’s deputy, who said he feared for his life.

Brandon Marshall, 43, was shot Dec. 10 outside the Saratoga office of Roku, a video streaming software company where he worked. Marshall had been among five named class members suing Adobe Systems Inc., Apple Inc., Google Inc., Intel Corp., Intuit Inc., Lucasfilm Ltd. and Pixar for conspiring to suppress wage growth by agreeing not to recruit each other’s employees.
