Claiming he was not properly paid for the hours he put in during a six-week stint as a contract attorney last summer, William Henig sued Quinn Emanuel Urquhart & Sullivan and legal staffing and recruiting agency Providus in federal district court in Manhattan Monday.

    Having experienced the horror of doc review during some downtime, I now find myself in the position of hiring doc review companies. For instance, I know who discriminates against women and who gives no HR training to team leads (and there are consequences). I will not contract with company that is setting up my corporation for a nasty employment lawsuit.

    It is possible that the work in question did not require a JD - like clicking through documents and counting faces or listing colors. It happens.

    Point taken. Sometimes it's the principle of the matter--even if he wins, we're not talking about a lot of money. Tough market out there too--$30/hour is pretty low and I'll be interested in hearing how much Quinn was paid for his work. I wonder what Quinn's client will pay for similar work in the future.

    I don't think this contract attorney is realizing the full implications of his suit for overtime. He's essentially making the argument that people without a JD can do document review, which means there is no reason for document reviewers to be paid more than a contract legal secretary or paralegal. So, if he wins his case for overtime, great, he gets compensated for the overtime hours that he has worked. However, he has also provided law firms and their clients with the perfect argument as to why contract attorneys should be paid even less than what they are being paid now. Overtime pay on minimum wage won't be much. Also, there are definitely plenty of firms that pay overtime on top of a decent hourly wage. Instead of filing this suit, perhaps that contract attorney should have looked for another project with overtime.
