For now, it’s still legal to play daily fantasy sports in New York state.

But it’s been quite the contest. On Dec. 11, New York Attorney General Eric Schneiderman prevailed against an all-star litigation lineup for the two leading daily fantasy sports (DFS) companies, DraftKings and FanDuel, when a state judge granted his motion for a preliminary injunction to halt the sites from doing business in the state. However, the same day the companies appealed to the Appellate Division, First Department, where Justice Paul Feinman granted an emergency stay allowing FanDuel and DraftKings to keep operating in New York through at least January. A full panel of the judges will then rule on whether the companies can do business in the state while the appeals process unfolds.
